Terms of Service

These Terms of Service ("Terms") govern your use of the payment and account-servicing software, websites, and messages provided by AmortPay, LLC ("AmortPay," "we," "us") (the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The Service

AmortPay provides software that independent auto dealers use to service accounts and accept payments, and that their customers use to make payments and view their account. AmortPay is a technology and payment-facilitation provider. AmortPay is not a party to the financing agreement between a dealer and its customer, and does not provide legal, tax, or financial advice.

Accounts and eligibility

You must provide accurate information and keep your credentials secure. You are responsible for activity under your account. Dealers must be authorized to do business and to service the accounts they manage on the Service.

Payments and fees

Payments are processed by our payment provider (Stripe) and are subject to its terms. Dealer subscription pricing and customer convenience fees are described on our pricing page and are disclosed before a payment is made. Amounts owed on an account are governed by the agreement between the dealer and its customer, not by these Terms.

Text messaging terms

By providing your mobile number and using the Service, you consent to receive account and transactional text messages from AmortPay and the dealer that services your account, such as one-time login codes, payment confirmations and receipts, payment reminders, and past-due notices.

  • Message frequency varies based on your account activity.
  • Message and data rates may apply.
  • Reply STOP to opt out of text messages at any time. Reply HELP for help, or contact team@amortpay.com.
  • Carriers are not liable for delayed or undelivered messages. Supported carriers may change.

See our Privacy Policy for how we handle your mobile number and messaging data. We do not sell or share your SMS opt-in or consent data with third parties for their marketing.

Acceptable use

You agree not to misuse the Service, including by attempting to access it without authorization, interfering with its operation, using it to violate the law, or using it to send unlawful or unconsented communications.

Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, AmortPay disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the fullest extent permitted by law, AmortPay will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising from your use of the Service.

Termination

You may stop using the Service at any time. We may suspend or terminate access if these Terms are violated or as needed to operate the Service. Your data can be exported before you leave, subject to legal recordkeeping requirements.

Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Texas.

Changes

We may update these Terms from time to time. We will post the updated version here and revise the date above. Continued use of the Service means you accept the updated Terms.
